WhatBreakfast.com respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have implemented procedures to address claims of copyright infringement that occur on our website. If you believe that your copyrighted material has been used in a way that constitutes infringement, please follow the procedure outlined below to file a DMCA takedown notice.
Filing a DMCA Takedown Notice
If you are a copyright holder or an authorized agent of a copyright holder and believe that content on WhatBreakfast.com infringes your copyrighted work, you may file a takedown notice by submitting a written communication that includes the following information:
- Identification of the copyrighted work that you believe has been infringed.
- Identification of the material that is claimed to be infringing (with enough detail to allow us to locate the material on the website).
- Your contact information, including your full legal name, mailing address, telephone number, and email address.
- A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.
- Your signature (physical or electronic) certifying the above information.
Once we receive a valid DMCA takedown notice, we will promptly investigate and remove or disable access to the infringing content.
Counter-Notice
If you believe that the content we removed (or to which we disabled access) was not infringing or that you have the permission to use the content, you may file a counter-notice. The counter-notice must include the following:
- Your contact information, including your full legal name, mailing address, telephone number, and email address.
- Identification of the material that was removed or to which access has been disabled, and the location where the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.
- A statement that you consent to the jurisdiction of the Federal District Court for the district in which your address is located (or if your address is outside the United States, the jurisdiction of the federal district court for the Northern District of California).
- Your signature (physical or electronic).
If we receive a valid counter-notice, we may restore the removed content within 10-14 business days unless the original complainant files a lawsuit.
Repeat Infringer Policy
By the DMCA and other applicable laws, WhatBreakfast.com has adopted a policy of terminating the accounts of users who are found to be repeat infringers. If you believe that a user is a repeat infringer, please notify us at the contact details below.
